Q: Can a peace officer search an on-campus residence?
A: Yes. Currently, the student housing agreement allows Syracuse University representatives, including Public Safety officers, to enter campus residences to conduct health and safety inspections and to respond to emergency situations and/or violations of University policies without search warrants. Under certain circumstances, the chief and/or the shift supervisor of the Department of Public Safety (DPS) may authorize a search of a University residence without a warrant if there are exigent circumstances or if the individual who is subject to the search voluntarily consents to the search. In some circumstances of a criminal nature, however, searches must be conducted pursuant to a lawfully issued warrant. In these cases, only a police officer may apply for the search warrant. Therefore, a peace officer must await the police to execute a search warrant. Exceptions can be made if the resident consents to the search or if there are articulable exigent circumstances, such as life-threatening situations. |
